Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Argento Headshots ("we," "our," or "us") regarding your use of our website and photography services.

By booking a session, using our website, or engaging our services, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not use our services.

Our Services

Argento Headshots provides professional photography services specializing in headshots for executives, actors, creative professionals, and corporate teams. Our services include:

• In-studio photography sessions
• On-location photography (where applicable)
• Professional retouching and image editing
• Digital image delivery via online gallery

Booking and Payment

Session Booking

• Sessions must be booked in advance via phone, email, or our online booking system
• A deposit may be required to secure your booking
• Session availability is subject to our calendar and cannot be guaranteed without confirmation

Payment Terms

• Full payment is due at the time of your session unless other arrangements have been made
• We accept major credit cards, debit cards, and digital payment methods
• All prices are in USD and subject to applicable taxes
• Prices may change without notice but will be honored for confirmed bookings

Deposits and Refunds

• Deposits are non-refundable but may be transferred to a future session within 6 months
• No refunds will be issued once a session has been completed
• We reserve the right to cancel sessions due to emergencies or unforeseen circumstances, in which case full refunds will be issued

Cancellation and Rescheduling Policy

Client Cancellations

• 48+ hours notice: Full refund or reschedule at no charge
• 24-48 hours notice: 50% cancellation fee or reschedule for $50 fee
• Less than 24 hours or no-show: 100% cancellation fee, no refund

Rescheduling

• One complimentary reschedule allowed with 48+ hours notice
• Subsequent reschedules may incur a $50 administrative fee
• Rescheduled sessions must be completed within 6 months of original booking

Weather and Emergencies

In case of severe weather, illness, or emergency situations, we will work with you to reschedule at no additional charge.

Session Conduct and Expectations

Client Responsibilities

• Arrive on time (late arrivals may result in shortened session time)
• Come prepared with appropriate clothing and grooming
• Follow photographer's direction during the session
• Limit guests to one person unless otherwise arranged
• Treat our studio, equipment, and staff with respect

Our Commitment

• Professional photography services using industry-standard equipment
• Expert direction and coaching throughout your session
• Clean, professional studio environment
• Respectful, courteous treatment at all times

Image Delivery and Usage Rights

Delivery Timeline

• Standard delivery: 5-7 business days from session date
• Rush 24-hour delivery available for $100
• Images delivered via secure online gallery with download access
• Gallery access available for 60 days; download your images promptly

Image Selection and Retouching

• You will select your final images during or immediately after your session
• Each package includes a specified number of professionally retouched images
• Retouching includes skin smoothing, blemish removal, color correction, and minor adjustments
• Additional retouching requests may incur extra charges
• Unselected proof images are not available for purchase or delivery

Copyright and Usage Rights

Your Rights:

• Unlimited commercial licensing for all delivered images
• Use images for personal and professional purposes (LinkedIn, websites, marketing materials, etc.)
• Make reproductions and distribute as needed

Our Rights (Photographer Retains Copyright):

• We retain copyright to all images created during your session
• We may use your images for portfolio, marketing, social media, and promotional purposes unless you opt out
• We will credit you when appropriate but are not required to do so

Restrictions:

• You may not alter, manipulate, or edit images beyond basic cropping and color adjustments
• You may not remove our watermark or claim authorship of the photographs
• You may not sell, sublicense, or transfer usage rights to third parties

Satisfaction Guarantee

We are committed to delivering exceptional results. However, photography is subjective and inherently artistic. We make every effort to meet your expectations but cannot guarantee specific results.

If you are dissatisfied with your images:

• Contact us within 7 days of image delivery
• We will review your concerns and work to address specific issues
• In rare cases, we may offer a complimentary reshoot (photographer discretion)
• Refunds are not available once final images are delivered

Limitation of Liability

To the fullest extent permitted by law:

• Our total liability for any claims related to our services shall not exceed the amount you paid for your session
• We are not liable for indirect, incidental, consequential, or punitive damages
• We are not responsible for technical failures, data loss, or force majeure events beyond our control
• We maintain insurance but are not liable for injuries sustained during sessions unless caused by our negligence

Backup and Data Loss

While we maintain multiple backups and take precautions to protect your images:

• We cannot guarantee against catastrophic data loss due to equipment failure, natural disasters, or unforeseen circumstances
• In the unlikely event of complete data loss, our liability is limited to a full refund of your session fee
• We recommend downloading and backing up your images upon delivery

Model Release and Marketing Use

By booking a session with Argento Headshots, you grant us permission to use your images for:

• Portfolio display on our website
• Social media marketing (Instagram, Facebook, LinkedIn, etc.)
• Print and digital advertising
• Photography competitions and exhibitions
• Client testimonials and case studies

If you do not wish your images to be used for marketing purposes, you must notify us in writing before or at the time of your session. Opting out may affect your eligibility for certain promotional pricing.

Dispute Resolution

In the event of a dispute:

• We encourage informal resolution through direct communication
• If informal resolution fails, disputes shall be resolved through binding arbitration in Los Angeles County, California
• These Terms are governed by the laws of the State of California
• You waive the right to participate in class action lawsuits

Termination of Services

We reserve the right to refuse or terminate services to any client who:

• Violates these Terms of Service
• Behaves inappropriately, disrespectfully, or abusively toward our staff
• Provides false information or commits fraud
• Repeatedly cancels or no-shows for scheduled sessions

In such cases, no refunds will be issued for services already rendered.

Changes to Terms

We may update these Terms of Service from time to time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of our services after changes constitutes acceptance of the updated Terms. For significant changes, we will make reasonable efforts to notify clients via email.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Entire Agreement

These Terms of Service, along with our Privacy Policy, constitute the entire agreement between you and Argento Headshots regarding our services and supersede any prior agreements or understandings.
